1. Scope of Engagement & Service Level Agreements
All commercial agreements executed with Excode Nigeria Limited (RC 007233) are governed by these Terms alongside specific project Scopes of Work (SOW), Work Orders, and signed Service Level Agreements (SLAs). In the event of technical conflict, the signed SOW shall take precedence.
2. Safety Stop-Work Authority & HSE Primacy
Safety is non-negotiable. Excode personnel and client safety officers maintain full Stop-Work Authority if unmitigated atmospheric hazards, structural integrity breaches, or non-compliant equipment are detected on site. Operations resume only when risks are formally signed off.
3. Site Access, Isolation & Permits
Clients are responsible for ensuring appropriate Permit-to-Work (PTW) issuance, energy isolation (LOTO - Lockout/Tagout), and mechanical plant depressurization prior to hydroblasting or vessel entry by Excode technicians.
4. Applicable Jurisdiction
These terms are governed by the Laws of the Federal Republic of Nigeria, with primary commercial jurisdiction vested in the Federal High Court of Nigeria.
